Assuming your daughter isn't an adult  and that she is staying with you permanently, you most certainly should be accepted as a homeless family.I am intrigued as to why any Housing Options Team should take a different view.

There may be questions about whether you are intentionally so (which could disqualify you from any right to re-housing), or whether the  pasrticular local authority where you are currently staying on your sister's floor is responsible for rehousing you( the local connection issue). 

  You must get direct, face-to-face advice asap from a local Housing Aid Centre or, failing that, Citizens Advice Bureau.  Check the Shelter website for details of such services in your area.

You do not say whether you have custody of your daughter and therefore there may be help you might need from your local Social Services department as they may be able to support your application for rehousing.  I agree with Nigel, unless you have intentionally done something in a previous tenancy you should be recognised as homeless and provided with, at the very least, temporary accommodation.  You also don't say where you are in the country, but if you are in an area of very high demand such as London you should seek additional support from the CAB, your local councillors and MP as they may get answers that you are having trouble getting, good luck, hope you get something soon.

    Thank you both for your responce. I'm a bit worried about under occupancy, as it's a 2 bed flat, but at lest we know its all overbroad. :)

    The crux of the issue is whether the property is deemed to be "more extensive" than required and the criteria will be contained in the Landlord's own policies and procedures.

    Those with lifetime (periodic) tenacies swapping with another person with the same will still swap using a "Deed of Assignment" and take over eachother's tenancies, not begin new tenancies.  BUT, if fixed-term or "affordable rent" is involved on either side, new tenancies are started.     I have recently joined twitter. I was initially reluctant but my son was very enthusiastic saying it was better than Facebook because it was easier to use, wasn't restricted to your " friends" and the limit on characters keeps comments short and to the point. For me twitting is a way to promote my articles and books to let others who share my interests know what is influencing me and to pick up on what others in my areas of interest are talking about.
