Yes this landord stupidly rented to 5 sharers so was asking for trouble. Had he rented to 4 with the fifth a non rent paying guest he could not have been (easily) prosecuted for breach of HMO regulations. Also very stupid and negligent not to install the correct fire alarm system as normally it is that which the Housing Inspectors and the Magistrates refuse to tolerate...after all an extra sharer does not represent a danger or a threat to live .An inadequate fire alarm system definitely does.

Indeed Joe it is NOT the fault of the local authority.
The Inspector in my area bemoans the fact that he does not have the power to exclude luxury multi million pound houses houses in Central London from compulsory licencing.
Yes the owner of a five million pound six bedroom house in say Mayfair is not permitted to allow his children who are students to house share with friends in term time unless both planning permission and a difficult to obtain HMO licence is applied for.
What nonsense ! NB speaking to friends in the USA and France it seems that non of this discriminatory anti sharer licencing exists in either of the major world cities of New York City or Paris. -

It might interest people to know that our dear Prime Minister shared digs at Oxford while he was a student there yet if the Council goes ahead with its anti student policy its ironic that students will not be able to find digs so easily in future !

Let us hope London boroughs do not go down this route as student accommodation is in desperate short supply esp in Central London where most colleges are situated.
Landlords are already finding loopholes in the regulations. One example is that to be a HMO the occupants must be permanent and rent paying and not be visitors or guests ie resident for 3 months or over. A landlord with several properties will switch the students between properties every three months to ensure the 3rd and 4th student stays less than three months in any one property !
