The recent 'grass cutting' case involving Two Rivers Housing Association v. freeholders shows the effect.
Without fundraising/ very decent solicitors/ no win no fee THOUSANDS of people would have been left paying for an illegal charge in perpetuity.
If there had been a proper system of access to the Law from the start a 3 year saga could have been dealt with promptly by the Courts. -

Words can be so tricky.
The 'rentcharge' on these properties is also termed 'estate maintenance charge' and therefore not redeemable via the land registry
This charge is also completely variable and dependant on the HA The closest comparables I can see are the charges imposed on leaseholders for maintenance etc. This is why I am shocked that these charges were not reflected in the purchase price at all.
It certainly looks like such charges by this HA are also illegal. However, as can be seen from the 3 year sage of the so called 'grass cutting', this private company seems to depend on individuals being unable to afford costly legal proceeding therefore they win by default.
This company were happy to impose huge obligations on post 2008 freeholders via land registry documents. Perhaps now they will not be so happy when they realise they have defined their own responsibilities.

'Emperors new clothes' springs to mind.
Proof? Based on years of experience on the front line.
The really sad part is that there are many decent, hard working people working for this particular RSL who have to deal with the flak.

The RSL system is feudal; both tenants and ex LA freeholders are treated as peasants. Contractual rights are disregarded as there is almost no access to the legal system.
The local RSL know the systems back to front= avoid accountabilty.
The LA are too intertwined financially with the RSL to be effective.
Collapse is inevitable...wonder if the financial backers have a clue what is giong on.
Debt mountain created by off the scale waste will be paid for by local taxpayers and tenants for GENERATIONS to come.
I am frankly gobsmacked this has all gone on so long.

Our RSL chief exec. is also listed on the annual report as 'Secretary'. Will this person be therefore paid for this as a seperate salry? how could I find out?
