true simon but at least I would have some empathy for that situation and there may be grounds for looking into it further if drug dependence was a mitigating factor. Saying the tenant is insulin dependent and that is grounds for overturning an eviction order is laughable

doesn't mean he doesn't have to abide by his tenancy agreement though does it.. Needing insulin is hardly a drug dependence problem either!

you can debate the extent of the problem but no-one will ever know for sure because it is so hard to detect. Subletting DOES happen. The issue is when it is detected it is currently virtually impossible to do anything about it and this change would rectify that.
Or are you happy to just leave it as it is? -

ah.. well that is the BIG picture.. as it currently stands within the current structure criminalising sub-letting is a step forward and it isn't surprising that it will disproportianately affect social housing so I think the author of this article is barking up the wrong tree. As I've shown above there are fair greater financial incentives to do it within social housing. That's before you even start taking succession rights et al into account..

I haven't interpreted the governments view as guilty until innocent (regarding sub-letting). They are just proposing a change in the legal stance on sub-letting which I think is long overdue.
Having said that I don't think the problem is endemic either (although seeing as it is by it's very nature difficult to detect and therefore impossible to tell how prevalent it is)
There are some who are completely unaware they are sub-letting but again, using my personal experience, the sub-lettee has always known what is going on and they are quick to pass mail/calling cards onto the official tenant which makes it harder to prove they are not using it as their main and principal home.
I would say there will be far more people 'in on it' so to speak who are happy to rent cheaper than the market rent even though they know the person they are handing their rent to is sub-letting. Ironically this is reinforced by the housing shortage. Because it will take so long to be housed by the LA they are happy to sub-let a property that they might have got direct for the true landlord via the proper channels and on the proper rental figure..
