Victoria - as a senior associate with your firm, would you be kind enough to state here under comments how you have ascertained ' theres not much evidence of public demand' as clearly the HAs do not keep statistical records of FOI requests they receive as they state they do not have a legal duty to respond. Also of course, where tenants may wish to see certain information - they do not make a FOI request as they know it will be refused. It also appears simply asking for specific information without making a formal FOI request also usually meets with a refusal. Also would you kindly clarify where you state ' FOI 2000 indirectly ......' do you mean under the circumstances you describe the HA must comply with the requirements of FOI and provide information when requests are made. I ask as my HA have refused a couple of requests I made over the years stating they have no legal responsibility or obligation to do so as they are not a public body. Finally would you be able to identify where in the FOI act or elsewhere I could read how a Court could justify making an order for a HA to comply with a particular type of request ? Regretably I am a tenant in social housing - hence do not receive any Rights or Legal advice and trust you may be kind enough to assist me with these matters? Finally, you mention the DPA - my HA deliberately fails to comply with many of the requirements of the Act - but regretably CAB and local Solicitors wont get involved !! How do I enforce my Rights according to current Legislation ?
