    If you mean are you breaching your tenancy by underoccupying, then the answer is no.

    If your landlord tries to recover possession, the Court will consider if it's reasonable to make a possession order.  They will consider the "under occupation" at the date of the hearing, not the date of death.  The Court also has to consider how long you've lived at the property and whether the alternative accommodation (the Council must offer you this) is a reasonable offer.  The onus is on them to prove their case, not you to prove yours.

    Nikki,

    What accommodation will you have in Devon?  If you're not accessing social housing there, then there's no advantage to you in terminating your current joint tenancy.

    Ask to see your LA's allocation policy as well.   Why can't your son apply to the LA in his own right (if he got a move he would terminate your joint tenancy, leaving you to move to Devon).

    I'm afraid it's all about timing and quite few variables, but do not give notice until you have clear information, in writing.

    Secure tenancies can be changed; there's a statutory process to follow, including opportunity for consultation.
