I am quite capable of understanding the law, moreover was Chairman and Founder of the Sheltered Housing UK Association, so I have some idea of the workings of the HOS. But, if you seek proof, I would suggest that you look at their statistics and just how many residents they have actually found for , last time I read it, it was about 6%
The problem with the HOS is that they now see themselves as an arbitration service, this permitted them in the case above to ignore the written word and seek a solution outside of it. The tenant expects them to uphold the contract full stop, otherwise the contract becomes meaningless. Contrary to what you have said, I gained the opinion that they were out of their depth and not as knowledgeable on the subject as one would have hoped -

Oh and P.S.: The HO ignored the fact that I had said that I would attend the hearing. without representation if I could record it , but the landlord insisted that I would have to accept their own version of events

To iluminate the above.
They ignored the right of representation at stage three of the RP complaints procedure.
They ignored that the RP did not agree a date for the stage 3 hearing went ahead and held stage 3 in my absence .
They ignored the fact that the RP took 5 months , and only responded to stage 3, after I had prompted them to.
They ignored the fact that the TSA had already advised my landlord that they should produce itemized Annual Rent and Service Charges demands
Were it not for the fact that I moved away from my previous landlords properties I was prepared to take the findings of the Housing Ombudsman to Judicial Review

I think one really has to understand the rationale behind forums and NVTs and resident involvement groups and it really goes back to privatisation by LSVT. To get the tenants to accept privatisation it was dressed up to look like they were joining a democracy with offered of forums and the like. This gave the impression that residents would have a real say , but in fact was a ploy to get them to vote for LSVT. Once the residents had voted for transfer then the Tenants Forum or residents focus groups became an embarrasment . They couldn't get rid of them because they were a part of the Offer Document to tenants, but at the same time they have no specific use because the contracts are between the Housing Association and each resident individually and nobody can vote on, or change a contract that belongs to somebody else.
Thus, a forum is nothing more than a talk shop. They were inherrited by the Housing Associations and were part of the master plan to get tenants to vote for LSVT. It has no powers . If like my own they become subverted and are given amounts of money each year to spend on childrens play areas, so subtely changing their anticipated role, which in truth never existed anyway !
