Dale Farm legal challenge dropped

Basildon Council has seen off a legal challenge against the clearance of the Dale Farm Travellers’ site.

Mary Flynn had argued that the action to clear the site in October was a breach of her human rights, with a High Court hearing scheduled for later this month.

But the case has now been dropped following comments from two High Court judges - Mr.Justice Parker and Justice Ouseley - during judicial review proceedings. The case had been the subject of an injunction application at the High Court in August but was thrown out by Mr Justice Parker.

Tony Ball, leader of the council, said: ‘I welcome that this case has been dropped and that no more court time or public money is wasted.

‘This is further evidence that the council has acted lawfully and fairly throughout this process and only ever wanted to uphold the planning laws of the land.’

Dale Farm was cleared in late October following months of legal wrangling between the Travellers and the council.
